There are certain inalienable rights and universal freedoms in the sanctity of one’s own home and space that transcend any kind of government control. A woman’s womb is the ultimate home – an inner home or space within one’s own home and space.

Regardless of Smith’s personal views regarding abortion, government has no right to invade this home or space. Smith also deems that it is healthy for the country to honor its flirtation with libertarian views on certain issues and abortion/choice is one of those issues.

Despite his libertarian legal position on the matter, Smith would not suggest abortion as a possible option after the first trimester, except in the case of incest, rape, or adverse health of the mother.
